AG Okays Vehicle Allowances
In a long awaited opinion (available in pod at right) , the Attorney General has concluded that local agencies may provide vehicle allowance to local officials. The opinion interprets the provisions of Government Code section 1223, which provides:
When traveling expenses are allowed by law to any state, county, judicial district, or city officer, he may contract with the appropriate authorities for an allowance or mileage rate for the use of vehicles owned or rented and used by him in the performance of duty, in lieu of the usual transportation charges.
The Attorney General concluded that AB 1234's provisions regarding expense reimbursement (specifically Government Code sections 53232.2 and 53232.3) did not repeal by implication section 1223.
